What is surrogacy?

Before we dive into more technical aspects of a surrogacy journey, let's learn a bit more about surrogacy definition, it's meaning, and how the entire process works.

Surrogacy meaning is defined as a fertility procedure helping the couple to become parents and be genetically related to their baby. Ukraine recognises only the gestational surrogacy where the surrogate mother is not biologically related to the child. The embryo is created with the help of In Vitro Fertilisation (IVF) or Intrauterine Insemination using the sperm or the egg of the intended parents and then transferred to the surrogate's uterus. The eggs or sperm could also come from a donor. In gestational surrogacy, one of the parents must be genetically related to the baby. The Intended Parents are recognised as the legal parents of the baby, and only the names of the married couple are written in the child's birth certificate. The name of the surrogate will be indicated only in the medical birth certificate.

How does the surrogacy process work?

The following steps should be considered to ensure that the gestational journey is seamless and doesn't have any legal implications:

1. Finding a surrogacy opportunity

Gestational surrogacy starts with the intended parents looking for a surrogacy opportunity. They can do this independently, involving an attorney who specialises in assisted reproductive law, or could work with a surrogacy agency, who will guide them through the entire process. 2. The signing of the Surrogacy contract

Before initiating a contract draft, both the intended parents and the gestational carrier will have a session with a lawyer to discuss their legal responsibilities and possible juridical risks. Once all parties agreed, they finalize and sign the contract.

3. Surrogate mother matching

After all the statutory provisions have been exhausted, the next integral phase is the surrogate mother matching. This milestone includes an array of medical check-ups, psychological assessment, general compatibility, and thorough health examination. After the surrogate is deemed fit to carry the pregnancy to term, both parties are expected to sign a consent that pertains to prenatal and postnatal processes. It ensures that all parties acknowledge the procedures.

4. Surrogate mother requirements

  • The woman between 18 to 36 y.o

  • Presence of at least one own healthy child

  • Absence of hereditary diseases

  • Lack of medical contra-indications for pregnancy

  • Absence of somatic diseases

  • Absence of negative manifestations

  • Absence of harmful habits: drug/toxic/alcohol abuse

  • Should pass all the required medical tests (you can find them in this guideline)

  • The SM can be single, married, or divorced. Special legal requirements of the Embassy are taken into consideration when matching the marital status of surrogate. The final approval of the SM is done only by the leading doctor; afterwards, she is matched with potential intended parents according to their blood group and physical characteristics

5. Implantation

Once everyone is satisfied, and consents are signed, the clinic will create the embryo using the intended parents' biometric material or involve the egg or sperm donor if needed through IVF and take charge of the embryo transfer. The surrogate will then undergo various fertility manipulations before the embryo transfer.

6. Pregnancy

The Intended Parents receive the monthly ultrasound reports with the detailed description and pictures as soon as the HGC blood test officially confirmed pregnancy. The Surrogate resides at her home during the pregnancy making monthly visits to the clinic. She moves to Kyiv on the 7th-month (to avoid jolting while travelling). The Surrogate stays in the maternity hospital until the official discharge date (2-5 days). The baby and the surrogate mother are located in different rooms to prevent physical contact between them. The intended parents can arrive before or after delivery day, but they are obliged to attend the discharge day of the baby. After the official discharge from the maternity hospital, the intended parents s can take the baby home and start parenting.

According to Ukrainian law, the surrogate signs the notarized consent. Based on this document, marriage certificate with valid apostille or legalization, and other documents, the intended parents receive the Birth Certificate at a Register Office. The IPs are declared as legal parents of the baby (no mentioning about surrogacy).

What are the laws governing gestational surrogacy?

No international laws are governing gestational surrogacy. There are some countries where the rules about this process are clear, while in some, regulations are relatively unsettled and complex.

It is, however, vital to note that the legal process in gestational surrogacy usually is less complicated than other types of surrogacy. This is because, in this type of surrogacy, one of the intended parents must be genetically related to the baby, which minimises, or rather eliminates possible custody issues.

Every country determines surrogacy laws on the globe, and some don't allow any form of commercial surrogacy. Therefore, make sure you work with reputable lawyers or surrogacy agencies to help you choose a destination where you will complete the process without falling on the wrong side of the law.
