WHAT IS 

SURROGACY?

 

 

Many couples dream of eventually being called parents; however, the increase of infertility challenges has prevented this dream from becoming a reality for many. Unfortunately, it is difficult for some couples to conceive or carry a pregnancy to full-term due to various health factors.

Nowadays, Surrogacy motherhood has become a popular solution on an international scale as it has substantial benefits over adoption, which often turns out to be a time-consuming, exhausting, and bureaucratic journey. Unquestionably, adoption is a noble cause, but deep inside, we all desire to have a tiny resemblance of ourselves, created from our flesh and blood. 

What is surrogacy? Surrogacy is a fertility procedure that consists of assisted reproduction technologies that enable the married couple to feel parental satisfaction and be genetically related to their child. 

Ukraine admits only the Gestational Surrogacy, which involves the Surrogate mother, who carries and delivers a baby for another couple and who does not have any biological connection to the child. The Surrogate's oocytes are never used to conceive embryos to prevent any genetic connection between the child and the Surrogate. In most cases, Intended Parents donate their own biomaterial, or a donor is involved if necessary. As per Ukrainian law, a Surrogate is obliged to waive all parental rights to the couple immediately after the baby's birth. We identify only the names of Intended Parents on the birth certificate.

 PARTICIPANTS OF THE PROGRAM

Intended Parent(s): Person(s) who become a parent of a child using the surrogacy method.

As a rule, the Intended/Biological Father serves as a sperm donor for fertilization and assumes all responsibilities and legal rights upon the birth of a child.

Intended/Biological Mother: Provides her oocytes for insemination and takes on all the maternal responsibilities after birth.

Egg or Sperm Donor: The intended parents may donate the sperm and/or the oocytes — but donor sperm, eggs, and embryos are also often used.  

Surrogate Mother (Gestational Carrier): The woman who agreed to carry a baby to term for the intended parents and to transfer all parental rights to the Intended Parents after the baby's birth

 WHY CHOOSE GESTATIONAL SURROGACY?

Gestational Surrogacy is the final option against infertility. Where all other ART procedures have failed, Surrogacy is the last chance for infertile Intended Parents to conceive their biological child. 

This process gained a very controversial reputation in some cultures in the majority due to misconception or misjudgment. 

 

The legitimacy and expenditures for Surrogacy greatly vary from country to country. Some European countries severely restrict or even recognize it entirely illegal. In countries, like the UK, Ireland or Canada, 'commercial surrogacy' (where the surrogate mother receives financial compensation) is illegal while 'altruistic surrogacy' (where the surrogate mother volunteers for such deal and gets a refund for expenses) is acceptable. In Ukraine, the process is legitimate and widely practiced. Please be aware that even in countries which consider Surrogacy legal, the juridical background varies greatly. In principle, a proper agreement needs to be drafted and should stipulate that the baby becomes the legitimate child of the Intended Parents. All parties must sign this document.

 WHO IS SURROGACY FOR?

People who have:

  • Diseases that make pregnancy and childbearing dangerous

  • Absence of uterus (congenital or acquired)

  • Deformations of the cavity or the cervix

  • Multiple unsuccessful attempts of IVF Changes in uterine endometrium, leading to the loss of the ability for implantation of the embryo and the adhesion of uterus that are not treatable

  • Presence of severe somatic diseases, in which the pregnancy is dangerous to a woman's health

 MANDATORY REQUIREMENTS FOR SURROGACY

  • The presence of medical reasons

  • At least one of the Intended Parents must provide their biometrical material for program participation  

  • Intended Parents should be a heterosexual, officially married couple. There is no minimum term of how long the couple must be married

  • Adequately completed documents needed for Surrogacy program

  • The surrogate mother should not have any biological relation to the child
